Go back to 1870 in East Texas, Google, now imagine your people owning a land grant.  Its 1980 and the land hasn’t been drilled on for gas or oil. This is the gigantic East Texas oil field with reserves for oil in the billions of barrels and gas in the Bossier-Haynesville Shale in the quadrillions, if you knew that by discovery, Exxon signed our lease knowing this.  A stream tapped into this field, it has been 35 years since the lease Gladewater Gas Unit #5, Wells #1 & #2 in 1981 was operated by what is now Exxon-Mobil has produced the commodities: shale oil and shale gas.  They had to go court or settle in West Texas, laws uncovered their ‘gas value chain’ and it had to pay millions but now it continues to swindle, my last check from Exxon was in 2013 for $0.13. 

This is where New Slavery rears its predatory scheme even after proving the title at the county seat, Gilmer, in Upshur County, Texas.  We have a lease but the white supremacy that controlled the oil and gas in Texas from 1922 thought we were all dead. The deed action sheriff said, “I ain’t never seen no dead people before!” when we went to title building in Gilmer.  In 1982 there were 75 people with deeds to the land that Exxon paid for a title opinion which had to go back to 1870. 

Instead of following oil and gas regulations the price was whatever Exxon prescribed with “field price” being the word or scheme which gatherers tapped the stream process that enabled from processing, marketing, and selling vectors for Exxon to skim off the top every step of the way.

OIL LAWYERS: ANY IN TEXAS?

If I needed a lawyer after a fender bender, no problem here in Dallas.  Lawyer commercials abound about how much money they demand for their clients.  But try to retain an oil and gas lawyer on a multimillion dollar fraud case with ExxonMobil as the perpetrator; none have called since 1983.  This is the "New Slavery" which was undercover here in Texas because of the money involved.  What about 20 quadrillion cubic feet of shale gas and billions of barrels of oil and a certified oil and gas lease with ExxonMobil, the Kingpin of the OIl/Gas Mafia? 

We signed the lease with ExxonMobil but it only has paid itself since then, us black mineral owners are contacting the US Attorney and the FBI, trying to get our fair share after 35 years.

 The evidence is beyond an opinion by a fly-by-night lawyer here in Texas, he will be paid off to protect XTO Energy Inc., the new overseer in the shale gas and shale oil field in Upshur County,Texas. 

This predatory element is going to have to front the Justice Department with its boss, soon.

Gladewater Gas Unit #5, Wells #1 and #2, Gladewater, Upshur County, Texas, operator XTO, Energy, a subsidiary of ExxonMobil has not produced gas or oil from this lease in the Haynesville/Bossier Shale and refuses to pay delay rentals on the lease as described in the 'Producer 88' ruling.  The last 35 years, 1980 to 2015, of this leases life has proven to be no more than a total breach of covenant and fraud.  The lease has produced billions of cubic feet of gas and heating fuel which Exxon-Mobil sold on the market and despite my 1/8th mineral interest in the 640 acre lease never shared the profits from the commodities: oil, condensates, and natural gas.
The resources from our land have and with the lease shut-in been underdeveloped in gas and oil shale of Texas, dismissing my rights as an American citizen.  An whole generation of heirs to this gas and oil have died while ExxonMobil pays Putin billions from their 'Equity Deal' which defines us as having no legal recourse or rights in Texas.  This meant that our destiny has for 35 years been in the hands of an 'Red Mafia' loving oil/mafia kingpin, #exxon which took from us what was our promise in America.

This should have happened 35 years ago at Gladewater Gas Unit #5, Wells #1 and #2 for all the good it has done my family when we signed an oil and gas lease with ExxonMobil in 1980.  The resources that determine so much to destiny were swindled from us because we are black and the ex-slave master mentality prevailed in Upshur County Texas.  How else could ExxonMobil justify profiting off billions of cubic feet of shale gas, condensates, and oil without paying us our fair share?
The land was acquired in 1870, clear title as the title opinion was cured by Exxon Mobil's attorney's in 1980.  It is now trying to cover-up this breach of covenant by shutting-in the lease and using its subsidiary XTO, Energy as an proxy operator.  It told me to get a lawyer when I asked about delay rentals.  Producer 88 will bite ExxonMobil in the tail with no statue of limitations as its defense.  It is breach of covenant time for this predator and its whole crew as the FBI and Justice Department has been advised of this 35 year oil and gas fraud in Gladewater, Texas.

What could Exxon gain from declaring that my granny was dead in 1989 and demanding that I present evidence that she was alive to insure her division orders for the oil and gas being produced at Gladewater Gas Unit #5 in Gladewater, Texas would continue to be deposited in her bank account? 

Why would an old woman be discovered wandering outside the nursing home after midnight, this attack was sadistic and designed to kill her which makes it important since Exxon has swindled the lease from day one by using unidentified taxpayers as gatherer of the oil and gas while denying our fair share of the profit from the gas, condensates, and eventually in 2006 oil at well #2.

Who made the order to cut off the oil at the lease in 2013 knew that it was breach of covenant but failed to realize I do too ignoring my notification of breach of contract mailed certified to their Houston office. Exxon has been trapped by its own arrogance and greed by me, the clever one.

How do you trap an entity bent on destroying the greatest promise of the United States of America, to own land in Texas clear with mineral rights under an oil and gas lease with the biggest oil company in world? The Kingpin of the Oil/Gas Mafia, ExxonMobil, drained the gas by billions of cubic feet and condensates from 1981 to 2014 at the lease in Upshur County, Texas.  It was no surprise that oil appeared in 2006 at well #2 because ExxonMobil secured reclassification of the well from gas to oil by the Texas Railroad Commission and prepared the well to produce oil in paying quantities which has amounted to pennies for my family even with oil spiking at $150 a barrel in 2008. So when the well was plugged in March of 2013 ExxonMobil showed its hand and breached our covenant with malice, in my opinion because we are black.  Time is the best evidence when dealing with gas and oil, a field has rules which will in time show what payment is being made and to whom for the hydrocarbons, so 35 years is the evidence, it speaks volumes of how a scheme was hatched to defraud and deny us our fair share of the profits from the commodities: gas, condensates and oil.  We received pennies on the billions for the gas and it made believing that ExxonMobil could plug an oil well in the Bossier-Haynesville Shale with oil bringing in $100 per barrel a joke, a cover up of 33 years of fraud and breach of covenant, it never intended on paying us, black Americans, from the point it discovered we owned the mineral rights in 1980. The cover up in this breach assigned XTO, Energy it role in 2014 as operator and it has curtailed production ever since taking over the operation of Gladewater Gas Unit #5, Wells #1 and #2 in Upshur County, Texas.

IN THE WELL OF EMPTINESS

The remnants of my family face a calculated threat that has existed since 1870.  The land then was cheap and any one with connections could purchase if they had the money. “This is where we make our home and pass this land on to the future generations: this is our land sons and daughters.” who would believe that a black woman could have so much vision.  The U.S. census listed her mulatto in 1890 along with her children in Gladewater, Texas, a town that would play in the great East Texas Oil field discovery in 1931.  The records show many of the descendants of Rebecca Allen left the land, either selling are being forced out by the law or Klan.  The land was last auctioned by the sheriff in Gladewater in 2008 as a show of disregard and contempt for our rights as citizens of the U.S.A. But I don’t want to get ahead of myself because time is key piece of evidence in what has happened in this former slave stronghold. 

We had heard from cousins that natural gas had been discovered in what is now Gladewater Field and it was from what they knew, on our land.  My great grandmother had passed in 1912 and the land she inherited from her father, Aaron Allen, had gone unnoticed until Exxon drilled a discovery well on eighty acres across from Gladewater and Lake Gladewater that came in prolifically.  This created a commotion in Gilmer at the title office for Upshur County where all the records of deeds were stored dating back to 1850’s.  Many produced deeds and titles at Exxon’s office to claim ownership of the land which prompted it to clear the title; this produced in this slave and Klan stronghold a surprise they never foresaw.  Essie, A.D., and Kizzie, Hattie Allen’s children were alive and well in Texas, a landsman contacted them in Wichita Falls and their lawyer contacted Exxon.  They were offered an oil and gas lease which they agreed to sign in 1980.  I was calling us, “The Black Beverley Hillbillies”,   the world of resources we had been without for so long as black people would finally be at our disposal.  The dream of America will be ours, the promise of freedom, the pursuit of happiness as guaranteed to us so long ago could be fulfilled; we had so much hope.

   It was 1989.  Exxon had been producing gas and oil from the lease, Gladewater Gas Unit #5, #1 and informed us in 1981 that it would probably never pay out which meant we had a worthless lease; it now wanted to know if my granny was alive.  The first move in a scheme that has left our hope and rights as American citizens in a shattered nightmare; we were as the slaves had been in Gladewater insubordinate if they even thought of being free or owning anything of value.  That hand of dehumanization, oppression, had reached up from hell to torture our very destiny as though we were still on its slave roll.  I knew we were in trouble.  The contact in the Exxon royalty office had stopped responding to questions, another well was drilled in 1993 at the lease, Well #2.  It was even more prolific than well #1 and would produce billions of cubic feet’s of natural gas until 2006.  The unidentified tax payers were piping the gas to the Gladewater Gas Refinery and telling us that gas was selling too low for there to be a profit.  Exxon was running a high-cost gas and oil pipeline, the only regulatory was the Texas Railroad Commission which approved its request for rule changes that made it possible for new leases or old ones for that matter to have three wells on a 640 acre lease. The oil was flowing.

Gas production was off the scales but we were not to share in those many years of profit at Gladewater Gas Unit #5, Wells #1 and #2, it, Exxon, jumped on our destiny, then played us for all it was worth.  The atmosphere of slavery pervaded any thought I had as I researched the database for production, 1981 to 2014, to see a flaw in this complex game we found ourselves in and realized the stakes were very high. It showed the Haynesville (Gladewater) field had produced hundreds of millions of barrels of sweet oil and hundreds of billions of cubic feet’s of natural just since 1980.  The oil and gas was deep, 12,000+ feet, to the pay zone that was hit on our lease in 1980.  There was no increase in the royalty interest, no delay rentals when the lease was closed to adjust the flow of the reservoir in the Cotton Valley Lime play in the Glen Rose formation. Experts speak on terms of gas in quadrillions since it is part of the lucrative Haynesville Shale and after gas there is oil.  The price of oil peaked in 2008 the Well #2 that was reclassified in 2006 as an oil well and prepared to produce oil in paying quantities was shut-in, turned off. This spoke volumes on what the scheme had been the entire history of the oil and gas lease: deny us our fair share of the profits off the commodities: oil, condensates and gas. The plan is to keep us forever broke with us sitting on an oil well, sounds like new slavery to me.  We have been deemed unworthy to be paid because we are black by what is now ExxonMobil, while the white royalty owners shared in the profits.  So I must take this as an attack on me and my family for 33 years to show us our place and that we have no rights in America.  I will assail this ExxonMobil to the highest reaches of our nation, put this on the Web, and call it out for what it is: slave breaker.  It might be asked why we but like in Russia and Saudi Arabia the citizens have no mineral rights when it comes to oil, that is what a government can do: ExxonMobil is not our government! Who is in control?

This malicious enterprise is not beyond laws for the citizens but it can spoil our harbors, rivers, and ground waters. It can tell states and their courts to kiss its ass with no comeback or legal remedy affronting its position.  No law suit has stopped its relentless strategic pursuit for control of gas and oil worldwide.  Yet it can still find time to subjugate me and my people 33 years as though we are on their slave roll and nothing can ever be done in America.  This scheme is wrought with the justification of slavery and contempt for freedom in the U.S.A...

EXXONMOBIL uses RACECARD: GLADEWATER GAS UNIT #5, GLADEWATER, TEXAS

The drilling platform was moved by ExxonMobil to the Arctic field on orders coming from the top: Putin.  The sanctions missed that move but it exposed ExxonMobil's commitment to the destiny of Russia even as it withdraws troops from the Ukraine at this very moment. 

 The EQUITY DEAL will be cut off just as Gladewater Gas Unit #5 is cut off in Texas. The only gas shale lease not producing in the Haynesville-Gladewater Shale but paying Putin delayed rentals despite knowingly not paying me for 34 years, it is where integrity and discrimination cross paths but my being black has been covered up by the transference of the lease to XTO, ENERGY a defendant in this ongoing fraud.

They think its 1814 and my land is their plantation and my people are their slaves.  They are beyond the law and take orders from their  Russian boss, Putin,  They are relics of an sinister time when it was easy to swindle black's of their land in Texas, produce gas and oil, keep all the profits with no of the law.

I need a super lawyer.  My problem goes back to 1980 when my grandmother,Essie Davis, signed an oil/gas lease with then Exxon in Upshur County, Texas.  This resulted in the production of billions of cubic feet of high cost natural gas which my family has never received a fair share of the profit.  When Gladewater Gas Unit #5 in 1993 added a second prolific gas well the Texas Railroad Commission changed the field rules to allow an exception, 3 wells, in an adjacent lease at the request of Exxon.  This well, #2, was reclassified as an oil well in 2006 and was shut-in in 2013 although it was producing.  The history of operation shows that we have never been paid delay rentals although both wells have been shut-in. The lease is under the control of XTO, Energy, a subsidiary of ExxonMobil, since January of 2014.  It informed me that I should secure a lawyer in that it has assisted me and will not any more.  That is tantamount to saying it will be another 34 years before we are accorded the same privileges of being paid a fair share of the profits off the commodities, gas, condensates, and oil as other mineral interest owners in the Gladewater field.  ExxonMobil has evidently tendered all the shut-in royalties to the other royalty owners disregarding the fact that I have a 1/8 th of the 640 acre lease.  I need a super lawyer as soon as possible.   

XTO: New Slavery Boss

What will a new oil and gas lease do for me? Let ExxonMobil off the hook is obvious, not signing until ExxonMobil pays up for 33 years of fraud.  Oil is either ID owner or you have none in America.  Oil is big money globally.

She said call her if she can do anything further, her job is to smooth a 33 year old fraud from going nuclear; her boss is ExxonMobil.  She e-mails con to me on XTO letterhead to confirm its complicity in the ongoing breach of contract at Gladewater Gas Unit #5, Wells #1 & #2. Every thirty days she can celebrate frustrating any effort I make to expose or express my rights as a black oil royalty owner at this lease is her mission.  

XTO, a XMO subsidiary is the cover-up with no good intentions for my family.  Why would it be any different: it relishes being the new master at GGU #5 and will be binded to legal challenges forthwith.

I told her, " The breach was acquired when your parent enterprise, ExxonMobil, relinquished Gladewater Gas Unit #5, Wells 1 and 2 to your control even though 33 years had elapsed without it paying my family a fair share of the profits from the production of the hydrocarbons; condensates, gas, and oil.  The lease is in underdevelopment as evident by the #2 well which produced from 1993 to 2006 as a gas well.  It was reclassified  as a oil well and subsequently shut-in in March of 2013 which signalled that our covenant has no value and portrays this subsidiary as a accomplice with no regard for me or my legal rights here in the USA.

The question will go nuclear as our plight is addressed to world opinion and examined as we are black being swindled like slaves.  Our only insubordination is the land and minerals belonged to us in 1870, any denial of our rights is from 1980 to 2014 is inclusive of our being black. It is no secret that Lee Raymond and Matthew Clark created an instrument to sustain a disenrichment that has lasted 33 years with us as the main target as a demonstration of ExxonMobil's contempt for my black family.  The rewards have been great for the "Company" at a generation of my people's expense with no regards for their welfare or respect as citizens of these United States of America.  No one owns us."

The evidence of fraud surfaced when unidentified taxpayer's began to gather gas from the lease in 1981 with regards to federal rules and laws. It has come full circle and ExxonMobil will have to unshackle me and my family, we are under no obligation to forsake our rights as American citizens.

When my forefathers were punished it was done to make any slave think twice about running away. They were dehumanized and oppressed from the cradle to the grave within that corrupt system: slavery.  We built the south up from wilderness with our unending labor, sun up to sun down, and no payment.  The land owners built enormous wealth off the labor of their slaves and considered them less than human, breaking their spirits, tearing their families apart, breeding them like animals, killing them for any reason that came along to serve their sadistic pleasures. It took a war to break this obscene disgrace to humanity, thousands loss their lives to bring freedom to these slaves and secure the future of our nation.

In one of the most notorious bastions of slavery, Upshur County, Texas which eventually became the East Texas Oil Fields in 1931, a New Slavery was rooted and sustained by those who miss the old days of slavery.  The deed, signed by my great-great grandmother Rebecca Allen is dated 1870 but from all indications it might as well have been a blank sheet of paper in 2014, with oil selling for a $100 per barrel. The combine of ExxonMobil and Gilmer (County Seat) have systematically since 1980 when my family signed an oil and gas lease returned to the old ways: slaves have no rights.  I say this because after 33 years we have received pennies on the millions at Gladewater Gas Unit #5, Wells 1 & 2. The record will show that we were never paid our fair share of the profits from the commodities: gas, condensates, and oil. We are in a nightmarish New Slavery right now in America with no one to back us, we lost a generation, Granny died broke, my mother died broke, and they had so much hope for what America promises in 1980. It might as well have been 1800, the way we have been denied our basic rights, and we might as well still be on the slave roll, living to make the master rich, dying with nothing but pain and suffering.

So, ExxonMobil is covering up this blatant breach of covenant by using its subsidiary, XTO Energy, now controls the lease and production after a year since the oil well was plugged.  Oil well plugged?  No way are oil wells being plugged in 2013 with the price of oil so high, not ExxonMobil! The Kingpin of the Oil/Gas Mafia can sign deals with Putin so he can finance the Olympics, it is called “The Equity Deal”, former KGB leader, Red Mafia Boss, is more a citizen of America than we are right now.  He gets his money up front in their new alliance with no interference from the feds but let me ask the feds to investigate my case, no way will it do anything: America?  We have been disenriched, destiny lynched, while the New Slavery got rich and punished us because we are Black.  You think it doesn’t hurt to imagine what my family should have lived in this free nation? The days of slavery are right in front, they are back for us and ExxonMobil is covering up how it robbed and tried to break the will of a Black Man.

What are rights? The Bill of Rights defines why I will make this examination of the disruption of my entire family’s destiny here in the United States of America, 2013.  This document backs anything our people might have to do to remain free and has been under attack since our nation was born.  The war for a nation bathed for centuries with the soul of black men, women, and children to either continue slavery or to destroy our freedom, our future, was on the line in the Civil War.  The aftermath was devastating for us of the new free because we had no land of our own and no understanding what ownership meant to a human being.  When my ancestors purchased land in 1870 in East Texas, the seemingly limitless expanse of land, made it go virtually unnoticed until 1980. 

Fortunes were being made after the East Texas Oil field was discovered in 1931 with oil reserves in the billions of barrels and natural gas in the quadrillions of cubic feet, a major oil discovery right where our land is. After fifty years of production of hydrocarbons Exxon drilled a high cost gas well on our land without permission or lease and hit natural gas in the Gladewater Field in Upshur County.  We signed an oil and gas lease in 1980 with the title opinion clear at Gladewater Gas Unit #5 with Exxon, securing our first division order and check in 1981. In retrospect, so many people had filed for ownership of the land in Gilmer, the county seat, that Exxon had no alternative than to cure the title or plug the well.  When the dust cleared my ancestors had purchased clear titled land in the middle of this enormous East Texas oil field, we were overwhelmed and humble, poised to have what natural gas and oil can do to your bank account: American Dream.  But after 33 years of analyzing our covenant with ExxonMobil it is evident that a trap was sprung that faithful day my grandmother signed that lease.

What kind of trap? What else could be left to do to us? We did not ask ExxonMobil to find natural gas and oil on our land? A new dynamic surfaced after evaluating a natural gas discovery that ExxonMobil informed us probably would never pay out, which would had increased our fair share of the profits from the hydrocarbons. When it demanded that we provide documents asserting that my grandmother was alive in 1989, the realization that authorities in Gilmer had set their trap.  

This center of Klu Klux Klan domination since 1922 had begun its on our rights as Americans which in my definition is a concrete example of NEW SLAVERY.  What?  The records show illegal auctions of land my great-great grandmother, Rebecca Allen had title to in Upshur County. Texas, in 1870. When the United States of America won the Civil War slavery was abolished to never exist on this land and the promise to pursue its destiny as a stakeholder is the right of every citizen of this great nation. If any one of us is denied this right to fulfil our destiny: America is denied its destiny.  It started adding up after 5,000,000,000 cubic feet of high cost natural gas was produced and gathered by gas gatherers with no tax identification numbers at the lease from 1980 to 2013 and we had no money in the bank. It is a fact that any other mineral royalty owner with natural gas or oil in the Gladewater Field has money in the bank; the field is prolific.  Why not us? This new slavery prohibits heirs of black landowners with mineral rights, gas wells, and oil wells from profiting from their production in a conspiracy that has ExxonMobil at its center: we are the proof.  This bizarre configuration has reinforced control of my and everyone in my family’s destiny by viewing us as still on its slave record.  We are to have only what it offers us, no hope for the future, witnesses to a generation blessed by an Angel struggling to survive when it should not had to, that is what it means to me when it comes to why so many died to give us freedom in the Civil War. 

 So we can’t be lynched anymore at the county court house at Gilmer but we are still oppressed by this challenge to our rights here in America.  Last I heard oil was $100 a barrel, any producing oil well in the Gladewater Field is making money, so what would ExxonMobil be thinking when after preparing a gas well that had produced 4,000,000,000 cubic feet of high-cost natural since 1993, Well #2, in 2006 to produce oil in paying quantities and then plug it in March of this year.

The inquiries I submitted were dismissed in the extent that ExxonMobil was aware that the Title Attorney in Gilmer had made mistakes in its opinion and it had failed to pay us delay rentals on the natural gas and eventually oil for any term of the life of the lease since 1980. This essentially dis-enriched us as the veil of fraud began to lift after oil replaced gas at the lease in 2006 and when the well was shut-in during the highest price surge for oil ever, $150 a barrel, it confirmed the strategy of this new slavery. The descendants of the slave owners in Upshur County, Texas had exacted their revenge, they have the power to order an oil well closed down if black’s could profit even if the gas or oil well was on land that they have owned since 1870, a 143 years. ExxonMobil created this scheme to show its contempt for black’s with total disregard for who might read this and establishment of its new slavery policy in the East Texas Oil and Gas Shale: What can be done?

This is not Putin’s Russia where oil kingpins can be put in prison but what is the difference if there are no oil laws being enforced by our government?  Where if you are black you better step back because you don’t even get paid for oil, ExxonMobil showed when it plugged an active oil well in the Gladewater Field in 2013. 

      

NEW SLAVERY: EXXONMOBIL'S EAST TEXAS OIL SWINDLE

We were in crisis from the day oil was discovered on our land, that ten acres of black gold, gas, condensates and after 26 years of gas production, Well #2 at Gladewater Gas Unit #5 which was completed in 1993 was reclassified as an oil well.  The lease was not terminated but the oil well was plugged in March of 2013 by the operator, EXXONMOBIL, which signed an oil and gas lease with my grandmother in 1980.

How is that possible? The biggest oil company in the world closing down oil wells in the Gladewater Field is where this crisis has controlled a generation of my family’s destiny.

We talked on a deep level that day, me and Dave, at our contract project trying to survive; I did not know his cancer had went terminal. “Why am I here?” he asked me with the most serious look I had ever seen on his face, he was tired, he seemed confused for the first time since I had known him. When his wife had left him after all those years he was not the same but he kept his business going and father a another son. He was amazing. I looked him straight in his eyes and spoke from my heart, “Daddy we all must die but the spirit will live on, we are divine, highly favored by the Great Spirit. I thank you and momma for my existence: I love you daddy!” tears were rolling down my face. 

He had been having all the time I knew him, we wanted for nothing and being black in the fifty’s in Wichita Falls, Texas that was the norm.  A base town for SAC provided a steady stream of money from the airmen and business would hire black men and women. Big Dave had control of the Kemp Hotel, he could hire or fire who he brought in to service the entire operation.  This was big time beyond the imagination of ordinary men and women working and raising families. Oil rich barons would descend there to plan and make deals with oil merchants who family’s had gas and oil from the 1920’s.  He made sure that their stay was one to remember and connected to their schedules for future visits to the Kemp. All that smoke in his café’s from 1970 until 1980 bought cancer on him and he never recovered. He suffered, we all suffered in his death, “How could such a man die?”

 

Momma was six years out from her reunion with daddy but it didn’t have to be that way if we had been given our fair shares of the profits from the hydrocarbons the lease. She would have had enough to survive and hold her own but she was denied her money from the gas by ExxonMobil who told her the lease would produce for no more than three or five years and not ever pay out.  The gas was being gathered by non-taxpaying companies so it was being diverted to the Gladewater Refinery with no tax and no regulation by the Texas Railroad Commission or feds..  By the time another well came in on the lease it was 13 years later, ExxonMobil had made a request to confirm in 1989: Was Granny alive?   Four years later the Gladewater Field rules were permitted to be changed by the Texas Railroad Commission and more than two wells were allowed per unit adjacent to our lease, Well #2 had been completed that same year; 1993. 

That began a 20 year unstated or calculated lease which produced billions of cubic feet of gas and condensates without us getting paid for our royalty interest or delay rentals. From what Lee Raymond informed us in 1980 about the well this was not a paid-up lease, it would not pay out: What about the paying-quantities test which the court must decide on from 33 years of production that ExxonMobil paid nothing.  Big oil giant Exxon closing down producing oil wells in the Haynesville Shale with oil at a hundred dollars per barrel does not fit its empire profile; How could it break an implied covenant of reasonable development for the lease? Is this the actions of a prudent operator whose purpose is making a profit with a producing oil well?

The violation of this implied covenant would sabotage any legal retreat for ExxonMobil if this case could be presented in a court of law.  But the system sustains this oil giant with positive rulings in higher courts regardless of its transgression from Val Dez to Alabama in recent cases. What makes my case different?
